Why Texas has a Constitutional right to defend its border with Mexico.
The United States Constitution says in Article 4, Section 4:
“The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence.” [Emphasis added]
The Unites States Constitution says in Article 1, Section 10, Clause 3:
“No State shall, without the Consent of Congress, lay any Duty of Tonnage, keep Troops, or Ships of War in time of Peace, enter into any Agreement or Compact with another State, or with a foreign Power, or engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay.” [Emphasis added]
Since the United States is clearly negligent in its Article 4, Section 4, obligation to protect the State of Texas against invasion and, since Texas is clearly being invaded by foreign nationals pouring over its unprotected southern border, it behooves Texas to exercise its Article 1, Section 10, Clause 3, right to act to defend itself against said invasion.
But, I guess it takes a Juris Doctor degree to misread that…
